Terms and conditions of sale


These terms and conditions of sale are entered into by CAROLLECTION, a company with capital of 1,000.00 euros, head office in Paris, registered with the Paris Trade and Companies Registry under number 823 106 018, hereinafter referred to as CAROLLECTION, for the first party, and by any individual or legal entity wishing to make a purchase via the CAROLLECTION website, hereinafter referred to as the buyer, for the second party.

Article 1. Purpose

These terms and conditions of sale define the contractual relationship between CAROLLECTION and the buyer as well as the conditions applicable to all purchases made through the CAROLLECTION e-commerce website, whether the buyer is a trade professional or a private consumer. The acquisition of a good or service through this website implies unconditional acceptance of these conditions of sale by the buyer. These conditions of sale shall prevail over any other general or special terms and conditions not expressly approved by CAROLLECTION. CAROLLECTION reserves the right to modify its terms and conditions of sale at any time. In this event, the applicable terms and conditions applicable shall be those in force at the date the order is placed by the buyer.

Article 2. Characteristics of the goods and services offered

The products and services offered are those listed in the catalogue published on the CAROLLECTION website. These products and services are offered while stocks last. Each product is accompanied by a description provided by the supplier. For some products, the buyer may have access to the supplier documentation. The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect representation of the product offered, particularly with regard to colours.

Article 3. Prices

The prices shown in the catalogue are inclusive of VAT in euros, applicable on the date of the order. Any change in the tax rate may be applied to the price of the products or services. CAROLLECTION reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day the order is made will be the only price applicable to the buyer. The prices shown include order processing costs, but do not include shipping and delivery charges.

Article 4. Geographical area


The online sale of products and services marketed on the site is reserved for buyers residing in France, Europe, United States and for deliveries required in these geographical areas.

Article 5. Orders

Customers wishing to purchase a product or service must:

- complete the registration form with all the contact details requested;

- check and confirm their order;

- make payment in accordance with the applicable conditions;

- confirm the order and the required payment.

Confirmation of an order implies acceptance of these terms and conditions of sale, full awareness of them and waiver of the right to invoke personal terms and conditions of purchase or any other terms and conditions.

The data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be deemed as a signature and acceptance of the transactions.The vendor will send confirmation of the order received by e-mail.

Article 6. Cooling-off


Buyers who are non-trade, natural persons, have a cooling-off period of fifteen days from the delivery of their order to return the product to the vendor for exchange or refund without penalty, with the exception of return carriage charges.

Article 7. Terms of payment

The price is payable when the order is placed. Payments will be made by bank card using the secure Hipay system, which uses the SSL (Secure Socket Layer) protocol. This ensures that data transmitted are encrypted by software and cannot be read by any third party during transmission over the network.

The buyer's account will be debited after the order is confirmed.
A VAT invoice can be downloaded from the customer's account area, or on request.

Article 8. Deliveries

Deliveries are made to the address indicated in the order, which can only be within the designated geographical area.The risks are borne by the buyer from the moment the products leave the premises of CAROLLECTION. In the event of damage during transport, a justified claim must be made to the carrier within three days of delivery. Delivery times are provided as an indication only; if they exceed thirty days from the date of order, the sale agreement may be cancelled and the buyer reimbursed.

Article 9. Warranty

All products supplied by the vendor are covered by the legal warranty provided by articles 1641 and subsequent of the French Civil Code.In the event a product sold is not compliant, it may be returned to the vendor, who will take it back, exchange it, or refund it. All claims, requests for exchange or refund must be made by post to the following address: JEMLogistique SASU 5 rue Louis ARMAND - Lot n° 4 94190 Villeneuve Saint Georges France, within fifteen days of delivery.

Article 10. Responsibility


In the online commerce process, the vendor is bound only by an obligation of means; they may not be held liable for any damage resulting from the use of Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.

Article 11. Intellectual property 

All elements of the CAROLLECTION website are and shall remain the exclusive intellectual property of CAROLLECTION. No person is authorised to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, whether partially or fully, elements of the site whether software, visual or audio.

Article 12. Personal data

In accordance with the French Data Protection Act of January 6, 1978, personal data relating to buyers may be processed automatically.

CAROLLECTION reserves the right to collect information on buyers, including by using cookies, and where necessary, to transmit the information collected to commercial partners.

Buyers may object to the disclosure of their contact information by notifying CAROLLECTION. Likewise, buyers have the right to access and rectify their personal data in accordance with the law of January 6, 1978.

Article 13. Archiving - Proof

CAROLLECTION will archive invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code.The electronic logs stored by CAROLLECTION will be considered by the parties as proof of communication, orders, payments and transactions between the parties.

Article 14. Dispute resolution

These terms and conditions of online commerce are governed by French law.

In the event of a dispute, jurisdiction shall be assigned to the competent courts of Paris, notwithstanding multiple defendants or the introduction of third parties.
